Few court cases have addressed similar complaints before. In a 1990 landmark Supreme Court case, Employment Division v. Smith, the Supreme Court ruled that a state could deny unemployment benefits to a person fired for using peyote, even though the drug was part of a Native American religious ritual. The court found that the state was not violating users’ religious liberty because the rule applied evenly to everyone.
In reaction to that decision, Congress passed the Religious Freedom Restoration Act, which made it more difficult for the government to pass laws that burden religion, requiring a strong justification for the law. All three suits are pursuing claims under that act.

Although Jeremy Lin loves basketball, he’s not fond of being on Broadway.
He’d much rather blend in than shine, but that’s impossible for the starting point guard of the New York Knicks. Going into Wednesday’s game at the Washington Wizards, the Knicks were 2-0 with the 6-3 Lin in the lineup.
Before starting twice over this weekend vs. the New Jersey Nets and Utah Jazz, Lin had only played 55 minutes in nine appearances in New York. But Lin averaged 26.5 points and 7.5 assists in those two victories for the Knicks, who were desperately seeking a true starting point guard.
Lin was an undrafted free agent but signed with the Golden State Warriors as a rookie last year. He only made 29 appearances and averaged 2.6 points a game there, but the experience was invaluable. Lin was from Harvard, the NBA’s first Ivy League player since the 2002-03 season and the league’s first Asian-American player.
“Last year was very helpful for this year. Last year, it was kind of like this before I ever played a game,” Lin says of the news media crush he experienced at Golden State. “It was a lot for me at the time. I struggled. It hurt me on the court just trying to get to the lights, the attention and everybody watching. I’m more prepared this year.”
Even when Lin was at Harvard, coach Tommy Amaker said he shied away from standing out. Lin ranked first all-time in games played there, fifth in points and assists and second in steals. He was one of 11 finalists for the Bob Cousy Award as a senior when he led the Crimson to their first postseason appearance since 1945-46.
“There’s a layer to him that he’s uncomfortable with all the attention,” Amaker says. “When he was here and things started to explode that way in college as he helped us grow Harvard basketball, he became somewhat of a cult figure around here and when we’d go on the road to play.
“He’d be a little uncomfortable with all that because it would elevate him to a status above his (teammates). That’s not who he is. He wants to be continually thought of as the same person, the same guy. It’s a different world and a different level now. It’s what he does for a living. Doing it in New York? That’s amazing.”
Hardly anyone expected Lin to blow up like this given the rough start to his pro career. The Warriors’ roster was loaded with guards, so they released Lin after the 2010-11 season. He was picked up off waivers by the Houston Rockets but they cut him before the this season started to make room for a post player.
Roger Montgomery, Lin’s agent, never gave up. He saw Lin play at Harvard on Dec. 6, 2009, against nationally ranked Connecticut. The Crimson lost 79-73, but Lin led all scorers with 30 points on 11-for-18 shooting. Lin, 6-3, also had nine rebounds, three steals and two blocks.
It was the same relentlessness Lin showed when he was overlooked coming out of Palo Alto High School in northern California. Lin wasn’t offered a scholarship after his senior year in 2005-06 even though he started on a 32-1 team that won the Division II state title by upsetting national power Mater Dei.
“I immediately said he’s a pro,” Montgomery says of Lin after the UConn game. “He’s an NBA player. I just liked his determination. I liked the way he attacked the basket, his athleticism. I felt like he had a chance at the next level.
“I didn’t expect him to get (a chance) this soon. We were hopeful that he would get a chance to showcase what he could do. We felt (coach) Mike D’Antoni’s system would be a good fit for him.”
The Knicks lacked backcourt depth and acquired Lin off waivers, but he was sent to the D-League’s Erie BayHawks last month. Lin was called back up to the Knicks, who were mired in a slump. They’d lost 11 of 13 games, and D’Antoni gave Lin his first NBA start after playing Toney Douglas and rookie Iman Shumpert at point guard. Veteran Baron Davis has yet to play this season because of a disk injury in his back and a right elbow infection.
Lin clicked with the team quickly, and Knicks center Tyson Chandler pointed to Lin’s demeanor as the reason for his success.
“He plays with patience, a nice speed. He sees the floor very well . Right now he’s really allowing players to get back to their national position,” Chandler says. “This whole year we’ve been having guys do things that they’re not normally asked to be doing. It’s good for guys to be able to come out and do what they naturally do well.
“It allows everybody else to calm down. At the beginning of the year everybody was running at the ball. It always turned into (isolations) because we had no movement. We had nobody to facilitate the actions. Now that he comes in he creates shots for people. You play basketball. You start making cuts. You start making reads rather than just standing and watching which is what we were doing.”
D’Antoni didn’t expect Lin to be a top scorer. He’d be more pleased if he distributes the ball and runs the offense. Little-used forward Steve Novak had a season-high 19 points in 17 minutes vs. the Jazz. It was Novak’s first double-digit scoring game of the season.
“By far (that’s) the most important part because then you can play guys like Steve Novak because the ball will find him, and if the ball finds him then we’re good,” D’Antoni says.
“(Lin is) extremely smart and grounded. He just plays his game. There’ll be some trials coming up. I see him as a guy that has some qualities you love in the a point guard. We just have to see what problems are presented and see if we can solve them.”
Chandler knows every game isn’t going to be a statistically good game for Lin. After teams develop better scouting reports on Lin, it’ll get tougher. The challenge for a young player to not lose confidence when they hit those lulls.
“He’s going to have those nights where it’s just bad matchups, which everybody goes through,” Chandler says. “The thing that he needs to do is consistently keep that ball moving, consistently keep that floor spacing. There’s there to be nights where he has eight points but hopefully he has 12 or 13 assists.”

Milwaukee archdiocese bid to duck abuse suits sparks ire

MILWAUKEE, Feb 8 (Reuters) – Milwaukee’s Roman Catholic archdiocese will ask a judge on Thursday to throw out hundreds of sexual abuse claims that have thrust it into bankruptcy, triggering a court battle and rekindling anger at the church’s mishandling of abusive clergy.
The aggressive stance taken by the archdiocese reminds victims’ advocates how leaders of the U.S. church long resisted pleas to deal harshly with offenders and fairly with victims during the decade-long scandal.
It also contrasts with earlier church bankruptcies where most victims’ claims of abuse were acknowledged and compensated, lawyers and experts said.
In court papers, the Milwaukee archdiocese is arguing in three test cases that the claims should be tossed out either because the abuse or church cover-up occurred too long ago, involved perpetrators such as a choir director who were not direct employees of the church, or involve victims who had already obtained settlements.
If U.S. Bankruptcy Court Judge Susan Kelley rules in the church’s favor, only 17 claims would remain out of 574 lodged against the archdiocese, said James Stang, a lawyer representing a committee of claimants.
“It’s not very pastoral of them to do,” Stang said of the church’s objections to the bulk of claims.
He said the archdiocese was utilizing Wisconsin’s strict application of the statute of limitations, which limits how long after the crime claims can be filed.
“It strikes me as heinously duplicitous,” said attorney Jeff Anderson, who has handled scores of clergy abuse cases and represents victims in the Milwaukee bankruptcy case.
“On the one hand the archbishop invites every individual who has been harmed and sexually abused to come forward to make claims with promises to be treated with respect and a measure of justice. And as soon as they do, he brings in a motion to pour salt in the wounds to have the claims thrown out.”
When the archdiocese filed for Chapter 11 bankruptcy protection in January 2011, Archbishop Jerome Listecki cited the financial drain of settling with hundreds of claimants while apologizing to the victims and acknowledging missteps by the church in dealing with abusers.
Tens of millions of dollars are at stake, with claims totaling more than $100 million.
Milwaukee is the eighth American diocese to declare bankruptcy, with the first three filed in 2004 in Portland, Oregon; Tucson, Arizona; and Spokane, Washington. Altogether, the U.S. church has paid out more than $2 billion in settlements, and the abuse crisis has spread around the world.
Other church bankruptcy cases were not as adversarial in resolving abuse claims as Milwaukee’s may turn out to be, said Jonathan Lipson, a University of Wisconsin law professor.
“I think it’s a pretty aggressive position at this point,” Lipson said, noting the archdiocese’s objections to claims come so soon after last week’s deadline for filing claims.
An archdiocese spokesman, Jerry Topczewski, said the six-year statute of limitations for fraud has passed in all three of the test cases. Fraud is alleged if church officials withheld knowledge about an abusive clergyman.
“Unfortunately, because you’re in a legal proceeding, you have to do things that people from the outside say, ‘Oh, you’re unfeeling,’” Topczewski said.
He said the archdiocese is pursuing its goal to emerge from bankruptcy with a plan of reorganization, which requires it to know who its creditors are and roughly what they are owed.
NAMING NAMES
The archdiocese began publicizing the names of offending clergy in the years after the abuse scandal first made headlines in Boston in 2002. There are 44 names of offenders on the archdiocese’s website, 19 of them deceased. Many of the claims date to the 1950s, 1960s and 1970s, which could doom them.
For victims whose claims are rejected, the archdiocese has asked the judge for permission to put an initial $300,000 into a “therapy fund” to pay for counseling.
“We’re trying to do the right thing, because we’re the church. Tell us the answer about who gets to be in the (bankruptcy) proceeding. But let us still do our ministerial job,” Topczewski said.
The archdiocese dealt with explosive charges in March 2010 against the late Rev. Lawrence Murphy, who had molested some 200 deaf boys over two decades. In Murphy’s case, Anderson has sought to push charges of a church cover-up up to the Vatican and Pope Benedict, who formerly was in charge of the Holy See’s disciplinary arm and interceded with the church in the case.
Stang contended the Milwaukee archdiocese has not been dealing fairly, citing a transfer of more than $50 million from church accounts to a Catholic cemetery fund, ostensibly for upkeep. A like amount had earlier been sought by abuse victims.
“The dynamics of these cases vary. They tend to be determined in part by the temperament of the lawyers as well as the temperament of the claimants,” Lipson said.
The claimants are hurt and angry in Milwaukee, an archdiocese with 633,000 Catholics.
“This has turned me away from the Church,” said life-long Catholic Adele Kotowski, 59. She had attended church regularly but stopped a few years ago when the abuse crisis became public, though she continued sending her granddaughter to a Catholic school.
The bankruptcy halted a process that many victims have been insistent about: full disclosure of the crimes and the cover-up.
“Among our clients, it was unanimous that until they come clean, until there is a disclosure and until there is exposure, there can’t be closure and we wouldn’t settle with them,” Anderson said.
